GENERAL PROVISIONS

This Privacy Policy has been developed in accordance with the requirements of the Law of the Republic of Kazakhstan “On Personal Data and Their Protection” dated May 21, 2013, No. 94-V ZRK, and also taking into account the provisions of the General Data Protection Regulation of the European Union (GDPR, EU Regulation 2016/679) as applied to data subjects located in the territory of EU member states.

This Policy governs the procedure for collecting, processing, storing, transferring, and protecting the personal data of individuals who interact with the website asiatrans.kz, as well as with the company’s employees when entering into contracts and providing services.

WHAT PERSONAL DATA WE COLLECT

We collect only the personal data that is necessary to achieve specific lawful purposes.

The data you provide voluntarily through the forms on the website: last name, first name, patronymic; phone number, including WhatsApp number; email address; company name and position, if specified; information about the cargo, route, and transportation conditions, as indicated in the application form.

Data collected automatically when visiting the website: IP address; browser type and version; operating system; the page from which you accessed the website; date and time of visit; pages you viewed; cookie data in accordance with the Cookie Policy.

The data obtained during the execution of the contract: the organization’s details when concluding a contract with a legal entity; the data of the company representative — surname, first name, patronymic, position, contact information; information required for customs clearance upon request.

PURPOSES OF PERSONAL DATA PROCESSING

We process your personal data solely for the following purposes.

Processing applications and calculating the cost of transportation — legal basis: the subject’s consent and pre‑contractual relations.

Conclusion and execution of the transportation contract — legal basis: execution of the contract.

Customs clearance of goods — legal basis: performance of the contract and legal requirements.

Communication with the client regarding transaction issues — legal basis: performance of the contract.

Sending commercial offers — legal basis: consent of the subject.

Maintaining accounting and tax records — legal basis: requirements of the legislation of the Republic of Kazakhstan.

Ensuring website security — legal basis: the operator’s legitimate interest.

Analytics and improvement of website performance — legal basis: consent of the subject via cookies.

TO WHOM WE DISCLOSE YOUR DATA

We do not sell or disclose your personal data to third parties for commercial purposes. Data disclosure is possible only in the following cases.

To state bodies of the Republic of Kazakhstan — on grounds provided for by law, including to customs authorities, tax authorities, and internal affairs bodies upon an official request.

To subcontracted carriers — in the amount necessary to fulfill the transportation contract, namely, the route and the contact person. Subcontractors undertake to maintain confidentiality.

Customs authorities and brokers — for the preparation of customs declarations within the framework of the agreement.

IT service providers, including hosting and the Bitrix24 CRM system, — exclusively for the technical support of the company’s operations. These providers are not entitled to use the data for their own purposes.

In all cases, data is transferred on the basis of an agreement with a mandatory confidentiality clause.

PERSONAL DATA STORAGE PERIOD

Data from website forms, including applications and inquiries, are stored for 5 years from the date of the last transaction or inquiry.

Contract data and primary accounting documentation are stored for 5 years in accordance with the requirements of the legislation of the Republic of Kazakhstan.

Data processed based on consent is stored until the subject revokes the consent.

Cookie and analytics data are stored in accordance with the Cookie Policy.

After the storage period expires, the data is destroyed or anonymized.

In accordance with Articles 9–11 of Law No. 94‑V of the Republic of Kazakhstan and Articles 15–22 of the GDPR, you have the following rights.

The right to know whether personal data about you exists, as well as the purposes and conditions of its processing.

The right to request correction of inaccurate or outdated data.

The right to request the deletion of data, known as the right to be forgotten.

The right to withdraw consent to processing at any time. Withdrawal does not affect the lawfulness of processing carried out prior to its receipt.

The right to receive data in a portable format — for EU customers in accordance with GDPR.

The right to file a complaint with the authorized body for the protection of personal data.

PROTECTION OF PERSONAL DATA

We take the following measures to protect your data: encryption of the connection to the website using the HTTPS and SSL protocols; limited access to personal data for employees — only for those who need it to perform their duties; mandatory confidentiality for all employees under the terms of the employment contract; regular updates of software and security systems; use of the Bitrix24 CRM system with access rights разграничения.

CROSS‑BORDER DATA TRANSFER

Due to the international nature of the company’s activities, some data may be processed outside the Republic of Kazakhstan — in the countries where the goods are destined, as well as on the servers of IT service providers. In these cases, we ensure an appropriate level of data protection in accordance with Article 22 of Law No. 94‑V of the Republic of Kazakhstan.

MINORS

Our website is not intended for persons under 18 years of age. We do not intentionally collect personal data of minors. If you become aware of the provision of data to minors, please contact us to have it removed.
