This Privacy Policy has been developed in accordance with the requirements of the Law of the Republic of Kazakhstan “On Personal Data and Their Protection” dated May 21, 2013 No. 94-V ZRK, as well as with due regard to the provisions of the General Data Protection Regulation of the European Union (GDPR, Regulation (EU) 2016/679) as applicable to data subjects located in the territory of EU Member States.

This Policy governs the collection, processing, storage, transfer, and protection of personal data of individuals who interact with the website asiatrans.kz, as well as with company employees in the course of concluding contracts and receiving services.

What Personal Data We Collect

We collect only the personal data that is necessary to achieve specific lawful purposes.

Data you provide voluntarily through website forms:

  • last name, first name, patronymic;
  • phone number, including WhatsApp number;
  • email address;
  • company name and job title, where provided;
  • information about the cargo, route, and transportation terms specified in the request form.

Data collected automatically when you visit the website:

  • IP address;
  • browser type and version;
  • operating system;
  • referring page;
  • date and time of visit;
  • pages viewed;
  • cookie data in accordance with the Cookie Policy.

Data obtained during contract performance:

  • company details when concluding a contract with a legal entity;
  • data of the company representative, including full name, position, and contact details;
  • information required for customs clearance upon request.

Purposes of Personal Data Processing

We process your personal data solely for the following purposes:

  • processing requests and calculating transportation costs — legal basis: data subject consent and pre-contractual relations;
  • concluding and performing transportation contracts — legal basis: contract performance;
  • customs clearance of cargo — legal basis: contract performance and legal requirements;
  • communication with the client regarding the transaction — legal basis: contract performance;
  • sending commercial offers — legal basis: data subject consent;
  • maintaining accounting and tax records — legal basis: requirements of the legislation of the Republic of Kazakhstan;
  • ensuring website security — legal basis: legitimate interest of the operator;
  • analytics and website improvement — legal basis: data subject consent through cookies.

Who We Share Your Data With

We do not sell or transfer your personal data to third parties for commercial purposes. Data may be transferred only in the following cases:

  • to state authorities of the Republic of Kazakhstan on the grounds provided by law, including customs authorities, tax authorities, and law enforcement bodies upon official request;
  • to subcontracted carriers, to the extent necessary for the performance of the transportation contract, namely the route and the contact person. Subcontractors are required to maintain confidentiality;
  • to customs authorities and customs brokers for the purpose of customs declaration processing within the framework of the contract;
  • to IT service providers, including hosting providers and the Bitrix24 CRM system, solely for the technical operation of the company. These providers may not use the data for their own purposes.

In all cases, data transfer is carried out on the basis of a contract containing a mandatory confidentiality provision.

Retention Periods for Personal Data

  • Data submitted through website forms, including requests and inquiries, is stored for 5 years from the date of the last transaction or inquiry.
  • Contract data and primary accounting documentation are stored for 5 years in accordance with the legislation of the Republic of Kazakhstan.
  • Data processed on the basis of consent is stored until such consent is withdrawn by the data subject.
  • Cookie and analytics data is stored in accordance with the Cookie Policy.

After the applicable retention period expires, the data is deleted or anonymized.

Your Rights as a Data Subject

In accordance with Articles 9-11 of the Law of the Republic of Kazakhstan No. 94-V and Articles 15-22 of the GDPR, you have the following rights:

  • the right to know whether we hold personal data about you, and the purposes and conditions of its processing;
  • the right to access your personal data;
  • the right to request correction of inaccurate or outdated data;
  • the right to request deletion of data, also known as the right to be forgotten;
  • the right to withdraw consent to processing at any time. Withdrawal does not affect the lawfulness of processing carried out prior to its receipt;
  • the right to receive your data in a portable format, for EU clients in accordance with the GDPR;
  • the right to lodge a complaint with the competent personal data protection authority.

To exercise your rights, please send a request to privacy@asiatrans.kz. The response period shall not exceed 15 business days.

Protection of Personal Data

We take the following measures to protect your data:

  • encryption of the connection to the website using HTTPS and SSL;
  • restricted employee access to personal data, limited only to those who need it to perform their duties;
  • mandatory confidentiality obligations for all employees under their employment agreements;
  • regular updates of software and security systems;
  • use of the Bitrix24 CRM system with role-based access controls.

Cross-Border Data Transfers

Due to the international nature of the company’s business, some data may be processed outside the Republic of Kazakhstan, including in the countries of cargo destination and on the servers of IT service providers. In such cases, we ensure an adequate level of data protection in accordance with Article 22 of the Law of the Republic of Kazakhstan No. 94-V.

Minors

Our website is not intended for persons under the age of 18. We do not knowingly collect personal data of minors. If you become aware that a minor has provided personal data, please contact us so that we can delete it.

Changes to This Policy

We may update this Privacy Policy. In the event of material changes, we will post a notice on the website. The date of the last update is indicated at the top of this document. Continued use of the website after publication of changes constitutes acceptance of the revised version.
